It was 2005, at the height of the Iraq war and they were rushing to have warm bodies over there so ones coming home just got lost in the shuffle!

They basically said that since we didn't get the physical the military has to prove it's NOT service connected and not vice versa. They claim is still pending it's appeal.

There are many groups that represent clients through VA appeals if you don't already have one. Groups like the American Legion and Disabled American Veterans represent clients through VA claims for free. I am currently represented by the DAV for my claim. I was represented by the AL for my first claim and I won that one. It is not hard. Just look the organizations up and give them a call. They act as an attorney-in-fact to you. And they know alot about the VA process. They will see that you get a fair shake.

Thats good that he has representation. I would not want to go it alone either. Especially with your case. I have gone it alone with the VA before when I first got out of the Marine Corps. I didn't know what I was doing. And I lost big time. Missed out on all kinds of benefits. I eventually appealed and won my case and received all the benefits I was entitled to. But I had to get representation with the American Legion to do it. It all turned out ok in the end.
